Your bankruptcy attorney can help by wiping out your debts or liquidating your assets and allocating them to creditors. They can also resolve your debts by developing a reorganization plant that has been approved by the court or any other plan that involves repaying the creditors over time. Your lawyer will also explain the bankruptcy processes and procedures and will help you fill out the proper applications. Title 11 of the United States bankruptcy code regulates these proceedings and informs you of the chapter you must file under. It will also explain the bills that can be eliminated, how long payments can be extended, what assets you can keep and any other details.

There are two types of bankruptcy proceedings attorneys practice. One is liquidation under Chapter 7. Known as the straight bankruptcy, Chapter 7 allows the debtor to turn assets over to the bankruptcy trustee who converts these assets into cash and them distributes them to the creditors. Bankruptcy attorneys also practice under debtor rehabilitation, which is authorized by the court as a payment of the debts over a period of time using future earnings. This is under Chapters 9, 11, 12 and 13.

Chapter 9 is the adjustment of debts for a municipality. Chapter 11 is known as reorganization, where a business continues to operate while repaying their creditors through a court-approved reorganization plan. Chapter 12 is the adjustment of debts of a family farmer with regular annual income as to alleviate debt from family farmers. Chapter 13 applies to debt relief to an individual or a consumer.
